NautiCheckAI – Website Terms of Use

1. Acceptance of Terms

By accessing or using the services of NautiCheckAI (hereafter "we", "us", "our"), including purchasing underwater photography, video, and observational reporting services, you agree to be bound by these Terms. We may amend these Terms from time to time; you are responsible for reviewing them periodically.

2. Services Provided

We offer underwater photographic and video documentation of marine structures such as hulls, pontoons, moorings, and jetties. Delivered reports are observational only and are not professional engineering, surveying, or structural assessments. Use of these reports does not constitute legal or certified advice.

3. Ownership and Usage Rights

  • You retain full ownership of all delivered media and reports.
  • By purchasing our services, you grant NautiCheckAI a non‑exclusive, royalty‑free licence to use selected images or short video excerpts (clips under 60 seconds or stills under 20 MB) for marketing or promotional purposes (e.g., on our website or social media).
  • You may opt out of this grant by providing written notice at the time of booking.

4. Delivery of Services

  • Deliverables are provided via email and/or cloud services such as Google Drive.
  • You are responsible for supplying accurate contact information and ensuring access to digital delivery platforms.
  • We aim to deliver final reports within 14 business days of the inspection.
  • We are not liable for delays due to incorrect contact details, third-party outages, or client-access constraints.

5. Limitations and Disclaimers

  • Reports are observational and not conducted by certified professionals.
  • Environmental factors such as water clarity, lighting, sediment, marine growth, and drone equipment limitations may impact visual quality and completeness.
  • No warranties—express or implied—regarding accuracy, completeness, reliability, or suitability for a particular purpose.
  • You assume all risk and responsibility for decisions made based on our deliverables.

6. Refund & Re‑Inspection Policy

  • Our services are offered for a fee; once footage or reports are delivered, no refunds or re‑inspections are available.
  • If no usable deliverables result from documented equipment failure, we may, at our discretion, offer a partial or full refund or complimentary re‑inspection.

7. Privacy & Personal Information

We collect only the personal data essential for service delivery (e.g., name, contact info, inspection location, and payment details).

Our practices comply with the Privacy and Other Legislation Amendment Act 2024 (Cth), which amends the Privacy Act 1988. Key updates include:

  • Stronger enforcement powers for the OAIC, including civil penalties for serious breaches.
  • Explicit requirements for "reasonable steps" to protect personal information through technical and organisational safeguards (e.g., secure storage, encryption, access audits).
  • A new statutory tort enabling legal action for serious privacy invasions, even without demonstrable economic loss.
  • Criminal offences for "doxxing" or harassing disclosure of personal information under the Criminal Code.

We uphold the updated Australian Privacy Principles and do not share your data, except as needed for service provision (e.g., payment processing, scheduling), and only with protection measures in place.

8. Legal Indemnity

By engaging NautiCheckAI, you agree to indemnify and hold harmless NautiCheckAI and its owners, operators, contractors, and agents from any claims, costs, damages, or losses arising from:

  • Your reliance on any report, photograph, or video provided;
  • Decisions based on those deliverables;
  • Environmental or technical limitations affecting image clarity or completeness; or
  • The non‑professional, observational nature of our services.

9. Jurisdiction

These Terms are governed by the laws of Queensland, Australia. Any disputes must be resolved in the courts of Queensland, to whose jurisdiction you irrevocably submit.

10. Client Access Responsibility

You must ensure safe, legal, and unimpeded access to the inspection site, including obtaining permissions for private marinas, moorings, or restricted areas. All operational safety and compliance obligations remain your responsibility.

11. Cancellation Policy

Cancellations with less than 24 hours' notice may incur a cancellation fee (e.g., 50% of the booking amount), at our discretion. Non-payment may result in rescheduling fees or service denial.
